    Quebec police shut down three medical cannabis dispensaries, also known as “compassion clubs” today, arresting all staff on site for trafficking. The Quebec closures follow a raid on a compassion club in Nunavut in February, in Toronto at the end of March, and in Guelph in May.

    “These national raids have now sent thousands of Canadians to purchase their medicine on the street,” said Micheal Vonn, Policy Director of the B.C. Civil Liberties Association. “The police by these actions have enriched organize crime, encouraged associated criminal activity, and shut down non-profit organizations dedicated to improving people’s health and wellness. By any standard these raids make no sense at all.”

    Compassion clubs have a rigorous approval process for cannabis sales, selling only to those with prescriptions from doctors or letters from physicians confirming chronic conditions that have been demonstrated to benefit from treatment with cannabis, and calling to confirm the authenticity of all documents with issuing physicians. The closed clubs were all at varying stages of actively seeking formal status with Health Canada.

    There are ten compassion clubs currently operating in British Columbia. Fourteen U.S. states have legalized medical marijuana. The use and possession of cannabis for medical purposes is legal in Canada for those with licenses from Health Canada.

    “Canadian courts have been clear that it is inappropriate for government to force sick Canadians to buy their medicinal cannabis on the street,” said Vonn. “These raids do exactly that. If government can’t bring itself to provide people with the medication they need in a timely and appropriate way, at the very least they shouldn’t harass and prosecute those who do.”

    Montreal police say they expect to arrest 25 people after raids on four clubs that say they provide marijuana for people who need it for medical purposes.

    A compassion club in Quebec City was also raided, but details of that raid were not available.

    Montreal police said the clubs' administrators and those involved in selling marijuana have been arrested.

    "People who are sick, who have authorization from Health Canada [to use medical marijuana], are not the ones targeted by our investigation," said police Commander Antonio Iannantuoni.

    Some clients of the clubs were receiving marijuana without the proper federal authorization, police said. In those cases, the clubs were involved in illegal drug trafficking, said Iannantuoni.

    In May, an investigation by the French-language service of the CBC raised questions about the ease with which it is possible to obtain marijuana from compassion clubs.

    After explaining that he needed the drug to deal with migraine headaches, a reporter with the Radio-Canada program Enquête was told he would have to provide a doctor's note or a sworn declaration from a commissioner of oaths.

    A staff member suggested the reporter say that he was suffering from chronic pain and directed him to a building down the street.

    A commissioner of oaths was waiting there to sign a declaration, for a $10 fee.

    The current investigation began in early 2010, said Iannatuoni, after police received several complaints about the clubs.

    'They just walked in out of nowhere'

    Police began serving warrants shortly after noon on Thursday.

    "They just walked in out of nowhere, showed us the paper and said, 'There's the warrant,'" said Maria Koklas, a volunteer at the Culture 420 compassion club in Lachine.

    "There's about 15 to 20 cops in here walking around inside the dispensary taking all of our membership IDs, asking them for all their personal information, asking them for their criminal records and letting them know if they don't have criminal records they will be free to go."

    In addition to the raid on the Lachine club, Montreal police are carried out operations at three clubs on the Plateau Mont-Royal.

    City police raided the Montreal club located on Papineau street in 2000. But when the case went to trial, a judge ruled it was unconstitutional to deny people an opportunity to get marijuana after saying they could use the drug for medical reasons.

    MONTREAL - Police have launched a major anti-pot dragnet in Quebec and say they plan to arrest 25 people for distributing marijuana.

    They are conducting raids at five cannabis clubs — better known as compassion clubs — in Montreal and Quebec City.

    The organizations supply marijuana, ostensibly as therapeutic treatment for people suffering from certain medical conditions.

    A police spokesman says no organized crime gangs are linked to the operations, but they remain illegal nonetheless.

    Canada has in fact allowed medical access to marijuana since 2001 but, police say, people who want permission to smoke it must go through Health Canada.

    Montreal police say people were just walking into these clubs, claiming to be sick, and getting easy access to pot.

    Four of the clubs are in Montreal, and one is in Quebec City.

    I think these compassion clubs needto put eveything on good video for protection. If they are playing games then they got to pay the piper. There has to be a way to cover there butts in every transaction. I think all patient info should be offsite for just this reason. Jerry

    I WAS one of those "illegal" users (in Guelph) but am now LEGAL ... I haven't changed ... just my doctor. The cops make it sound like anyone can join ... you still have to have a medical condition that qualifies you.

    MONTREAL - Police have done the Mob and street gangs a favour by cracking down on cannabis clubs, say pot decriminalization advocates.

    They warn that people will now be buying their stuff from criminal networks instead of tax-paying businesses.


    Thirty-five people were arrested in raids on Quebec's so-called "compassion clubs" — storefront outlets operating in plain view — while 90 kilograms of cannabis were also seized Thursday.

    Those clubs in Montreal and Quebec City offered a wide selection of marijuana for about $10 a gram to customers who claimed a medical condition and provided a doctor's note.

    Police argue that the clubs were selling to healthy people and essentially were drug-trafficking operations. A police spokesman says those arrested were all released after promising to appear in court on June 23.

    Sen. Pierre Claude Nolin says users of medicinal marijuana are now forced to find it elsewhere, and the vast majority will wind up getting it from criminal gangs.

    After making the arrests, police themselves declared that the clubs had no connection to criminal gangs.

    "It's the most disastrous consequence of the whole operation,"
    Nolin said in an interview.

    "The vast majority will have to look at the black market . . . and the substance on the black market is not exactly the quality substance that are received in the clubs."

    "In the clubs, they are trying to have access to organic cannabis, which is not the case with the black market."
    He says research suggests there are roughly one million Canadians who say they smoke cannabis for medical purposes, while less than 5,000 such permits have been issued by Health Canada.

    That means, he says, the vast majority will have to find their supply elsewhere.

    An official for the federal Justice Department said there would be no comment on the cases. All questions were referred to Health Canada.

    The Health Canada website says that, as of June 2009, 4,029 people had authorization to possess dried marijuana for medical purposes and 2,360 were allowed to cultivate or produce it.

    A pie chart indicates the largest number of permits — 1,631 — were issued in Ontario, followed by 1,008 in British Columbia. Nova Scotia was third with 491, followed by Quebec with 305. In Alberta, 282 people were given permission to use cannabis for their health.

    Marc-Boris St-Maurice, who runs Montreal's downtown Compassion Centre, was among those arrested and released during the police raids.

    He's sure people seeking cannabis for health reasons will still find it, and he predicts "people are just going to be doing it in back alleys."

    "There are scrupulous people in the marijuana industry — but it's more the inconvenience of running around," said St-Maurice, the founder and onetime leader of the federal Marijuana party.

    "If someone is sick or suffering, they don't need that additional stress of wondering if they're gonna get ripped off or if they're gonna get arrested in the process."

    St-Maurice has six employees helping him support 1,500 club members.

    "It's a drop in the bucket compared to how many people smoke marijuana in the city of Montreal on a given day," he added.

    On Thursday, police seized just over 86 kilograms of marijuana and almost four kilos of hashish, which would put the street value of the seizure at just around $900,000.

    They also confiscated about $39,000 in cash.

    Nolin, a longtime advocate for relaxed drug laws, doesn't blame the police. He says they were likely acting on a complaint and were bound to apply the law.

    The Tory senator notes that the same thing happened in the past to a compassion club in Victoria, but the court decided to acquit the club.

    "(It's) basic police work," Nolin said.

    "If the police is receiving a complaint, they don't have the choice but to intervene. That is their job. That's the job society is asking them to do and we don't have to judge them if they receive a complaint."

    Some neighbours who lived near the cannabis clubs did complain to media after Thursday's arrests about people loitering around the buildings, and about the pungent smell emanating from them.

    Nolin chaired a Senate committee that recommended in 2002 that pot smoking should be legal for any resident over 16.

    He has visited several compassion clubs — including the ones in Vancouver, Victoria and, as recently as two weeks ago, the Quebec City club.

    "Before opening they invited police so they would know how they operate and how the club operates," he said.
